US SupCt, Day 2 Luipold-Norman

  1. On the second day the Justices seemed very skeptical of Obama's health care law .The justices posed many repeated and largely unanswered questions on the limits of federal power. They question whether the Constitution gives congress the power to force Americans "to purchase health insurance or pay a penalty." Justice Kennedy and Roberts indicated that the case might be a close call for them. The arguments on this day were the most dramatic so far. The session was concluded with, "Counsel, We'll see you tomorrow."

On day 2 the Obama administration and opponents of the Affordable Care Act (ACA) debated the mandate to obtain health insurance coverage or pay a penalty.Justice Stephen Breyer brought up the idea of the "broccoli possibility" which argues that the mandate could open the doors for Congress to require all Americans to eat broccoli. Justice Anthonly Kennedy asked "Can you create commerce in order to regulate it"? The arguments went on, but at the end of the day healthcare-law expert Lawrence Gostin said that a majority of the high-court justices could vote to strike down the individual mandate.

  3. On day two the debate was between President Obama and the justices over whether the Affordable Care Act (ACA) could stand on its own, or if it needed the mandate. Justice Anthony Kennedy said about the ACA that it "threats to change the relationship between the government and the individual in a profound way." This is a quote that other justices think that might end the case over whether or not to allow the Affordable Care Act.

On the second day some justices were conflicted and asked whether or not this mandate would make it possible for Congress to compel us to buy other things like burial insurance, broccoli, gym memberships etc.. Obama made a comment that overturning the ACA would be judicial activism, Romney and others disagreed with this comment.
